Feix Terms of Service

Feix is operated by Llull Lab (Firat Ilim, entrepreneur individuel), SIREN 988 721 320, 61 rue de Lyon, 75012 Paris, France. Feix is sold for professional use. By engaging Feix you confirm that you are acting for purposes relating to your trade, business, or profession.
1. The service
Feix builds complete custom digital systems from your brief: interface, automation, database, hosting and delivery, as described at feix.app. Two delivery modes exist: Feix-managed (we host and operate your system) and self-hosted (we build and deploy on your infrastructure).
2. The pilot
We build first. You receive a working system and evaluate it in your own context for one week. If you adopt it, we agree a scope-based project price. If you do not adopt it, the system is removed, your project data is deleted (Privacy Policy, Section 7), and no invoice is issued.
3. Accounts and access
Access is invite-based. Keep your access token confidential; sessions may be revoked on abuse.
4. Acceptable use
No unlawful content or use, no systems whose primary purpose is deception, surveillance of individuals, or processing of special-category data without a prior written agreement.
5. Your content and intellectual property
Your brief and your system's data are yours. Upon payment for an adopted system, the delivered system (interface files and workflow definitions) is licensed to you for unrestricted business use, including export and self-hosting; there is no vendor lock-in. Generic building blocks, internal tooling and know-how remain ours. White-label terms are agreed per project.
6. Computational generation: no guarantee of fitness beyond evaluation
Systems are generated computationally and reviewed before delivery. You evaluate the system during the pilot; adoption confirms it meets your requirements as delivered. We do not guarantee outcomes beyond the delivered functionality.
7. Hosting and maintenance
Feix-managed systems include 90 days of hosting after adoption; afterwards a maintenance plan or migration to your infrastructure. Uptime and response targets are defined by the chosen maintenance plan.
8. Payment
Scope-based project price agreed after the pilot; maintenance plans billed monthly. Prices are in EUR. For invoices issued while the operator benefits from the French franchise en base regime: TVA non applicable, art. 293 B du CGI. If applicable law requires a local VAT, GST, or similar indirect tax, that tax is shown on the invoice.
Feix is sold to professional customers, who do not benefit from the consumer right of withdrawal. Where mandatory law nonetheless grants you the protections of a consumer, including a very small professional covered by Article L221-3 of the French Code de la consommation (five employees or fewer, contracting outside your main field of activity), those rights prevail.
9. Privacy and data protection
The Privacy Policy at feix.app/privacy applies. Customers whose Feix-managed system processes personal data of their own users can request a DPA (GDPR Art. 28).
10. Availability
We aim for continuous availability but do not guarantee uninterrupted service outside agreed maintenance-plan targets.
11. Liability
To the extent permitted by law, our aggregate liability arising from the service is capped at the fees paid in the 12 months preceding the event, and we are not liable for indirect or consequential loss. We do not exclude liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be limited or excluded under applicable law. Where mandatory law grants you consumer protections (Section 8), nothing here limits your statutory rights.
12. Termination
Either party may end hosting/maintenance with 30 days notice. On termination, Section 7 of the Privacy Policy governs deletion and export.
13. Governing law and disputes
These terms are governed by French law. For professional customers, the competent courts are the courts of Paris, France, unless mandatory law provides otherwise. Where mandatory law grants you consumer protections, disputes may be brought before the courts competent under those rules, including those of your place of residence where applicable.
